SOMOS CAMBADOS PRESENTA UNHA MOCIÓN EN DEFENSA DA LIBERDADE DE EXPRESIÓN

Somos Cambados

O secuestro do libro Fariña, a censura na feira ARCO, as ameazas polo pregón de entroido compostelán, a sentenza pola letra dunha canción, ou a acusación de atentado a autoridade de Emilio Cao son exemplos de como nos últimos días se puido vulnerar a liberdade de expresión.

O voceiro de Somos Cambados, Tino Cordal, destacou que a liberdade de expresión e un dereito humano fundamental e universal: todas e todos temos dereito á liberdade de opinión e de expresión, que inclúe o dereito a manter unha opinión sen interferencias e a buscar, recibir e difundir información e ideas a través de calquera medio de difusión sen limitación de fronteiras, tal e como establece a Declaración Universal dos Dereitos Humanos.

No Estado español, algúns acontecementos ocorridos nos últimos anos poden comprometer este dereito básico das persoas, claramente recoñecido no noso ordenamento xurídico, co obxectivo de limitar e conter o citado dereito á liberdade de expresión. De feito, a organización Amnistía Internacional xa denunciou no seu informe anual a restrición desproporcionada da liberdade de expresión en España.

Así, estamos a observar na actualidade como se reprime a discordancia política e se vulnera a liberdade de expresión: secuéstranse libros e revistas; prohíbense cancións; criminalízanse reunións, protestas e mobilizacións; censúranse obras de arte; castíganse bromas nas redes sociais, etc. A modo de exemplo, describimos a continuación como nos últimos días se puido vulnerar a liberdade de expresión:

–O rapeiro Valtónyc foi condenado a tres anos de cárcere por “calumnias e inxurias graves á coroa e enaltecemento do terrorismo” polas letras das súas cancións.

–A feira de arte ARCO censurou unha obra sobre presos políticos que inclúe a Jordi Cuixart, Jordi Sánchez e Oriol Junqueras.

–A fiscalía pide para Emilio Cao, un estudante de Filosofía do Carballiño (Ourense), cinco anos e oito meses de cárcere, ademais dunha multa de 6000 euros tras ser detido en maio de 2014 no decurso dunha manifestación das Marchas da Dignidade en Madrid.

–O Alcalde de Santiago de Compostela, Martiño Noriega, recibiu nestes días pasados ameazas moi graves contra el e a súa familia por permitir a difusión dun pregón satírico polas festas do Entroido.

–O libro “Fariña”, obra que afonda no narcotráfico galego, do xornalista Nacho Carretero, foi secuestrado por orde xudicial. O motivo: unha demanda dun ex-alcalde por suposta vulneración do seu dereito ao honor.

E todo isto, nos últimos días, pero poderíamos indicar moitos máis exemplos sucedidos nos últimos meses. Xa que logo, estamos a presenciar unha grave vulneración de dereitos civís e unha intensificación da persecución pola vía penal de certos actos que nos retrotraen medio século atrás (aos tempos do réxime franquista), mentres vemos como a corrupción non se persegue con tanta virulencia.

Estes recortes na liberdade de expresión son, en boa medida, consecuencia da entrada en vigor, o 1 de xullo de 2015, da Lei Orgánica 4/2015, de 30 de marzo, de protección da seguridade cidadá, coñecida como “Lei Mordaza”, exemplificación clara da penalización da liberdade de expresión e das condutas periféricas a ela coa finalidade de amedrentar e disuadir a todas as persoas que se atrevan a protestar e manifestarse publicamente. O Congreso dos Deputados aprobou os días 29 de novembro de 2016 e 21 de marzo de 2017 a derrogación da citada lei pero a mesma segue en vigor.

Por todo o exposto anteriormente, Somos Cambados solicita ao Pleno da Corporación do Concello de  Cambados que adopte o seguinte acordo, expresar o noso apoio e solidariedade a todas as persoas que vexan vulnerado o seu dereito fundamental á liberdade de expresión e instar ao Goberno de España a derrogar a Lei Orgánica 4/2015, de 30 de marzo, de protección da seguridade cidadá, tal como aprobou o Congreso dos Deputados os días 29 de novembro de 2016 e 21 de marzo de 2017.
