MOCIÓN PARA ESTABLECER MELLORAS FISCAIS NA TRIBUTACIÓN DAS DEVOLUCIÓNS DAS CLAUSULAS ABUSIVAS DOS PRESTAMOS HIPOTECARIOS

Clausula suelo 2.jpgCon motivo da aprobación do consello de ministros do pasado venres 20 de Xaneiro, o Real Decreto-lei 1/2017, de medidas urxentes de protección de consumidores en materia de “cláusulas suelo” no cal se atende a parte das demandas do acordo de goberno presentado, pero non a súa totalidade, procede modificar o acordo quedando redactado do seguinte xeito:

Exposición de motivos:

 clausulas-suelo-5A recente sentenza do Tribunal Europeo que ven de anular o limite temporal da sentenza do ano 2013 do Tribunal Supremo polas cláusulas pouco transparentes que viña introducindo a banca nos prestamos hipotecarios, as denominadas “Cláusulas Suelo”, xunto coa sentenza do Tribunal Supremo na que se declaran como abusiva a cláusula dos gastos da hipoteca, abre a porta a unha serie de reclamacións xudiciais por parte dos numerosos afectados, e que so no primeiro dos casos xa se estiman en preto de 4.200 millóns de Euros o importe a devolver polas entidades financeiras.

clausulas-suelo-3Pola súa banda o Consello de Ministros do pasado venres 20 de Xaneiro,a través do Real Decreto-lei 1/2017, de medidas urxentes de protección de consumidores en materia de “cláusulas suelo” establece na Disposición Final Primeira, unha modificación da Lei 35/2006 de IRPF establecendo un sistema de tributación especial para as cantidades devoltas en concepto de intereses pola aplicación de cláusulas de limitación de tipos de intereses de prestamos, pero pola contra deixa fora os contribuíntes afectados pola comercialización de produtos bancarios contratados en lesión dos dereitos dos consumidores, como son a cláusula dos gastos da hipoteca, e polo tanto a tributación dos afectados polos acordos ou polas sentenzas que resolvan as controversias sobre esta materia.

clausulas-suelo-1Dende o goberno do Concello de Cambados entendemos que se deben establecer regras especiais de cuantificación non so para as cantidades devoltas en concepto de intereses pola aplicación de cláusulas de limitación de tipos de intereses de prestamos, se non tamén para todas as cláusulas declaradas como abusivas dos prestamos hipotecarios, como son a dos gastos da hipoteca, e que tributen polo tanto  ao marxe da norma xeral do imposto.

Introducir unhas medidas fiscais co fin de evitar posibles prexuízos fiscais ós contribuíntes afectados, no caso no que nos atopamos das cláusulas abusivas nos prestamos hipotecarios, o lexislador semella que so entende como tal, as cláusulas de limitación de tipos de intereses de prestamos e non os gastos bancarios. Polo que, entendemos que o Real Decreto-lei 1/2017, debe incluir as clausulas dos gastos bancarios dentro da Disposición Final Primeira, e incluilos dentro sistema de tributación especial para as cantidades devoltas deste tipo de produtos financeiros considerados como abusivos e lesivos para os contribuíntes e establecerse unha lexislación especifica para a tributación e cuantificación das rendas derivadas dos mesmos.

clausulas-suelo-4En conclusión, instamos á Corporación do concello de Cambados a adotar o seguinte acordo:

1.- Que a corporación local do Concello de Cambados inste a Xunta de Galicia a reclamar ó Goberno do Estado, a incluír dentro do Real Decreto-lei 1/2017 non so ós afectados polas cláusulas de limitación de tipos de intereses de prestamos, senon tamen ós contribuíntes afectados polas cláusulas dos gastos dos prestamos hipotecarios, e de tódalas cláusulas consideradas como abusivas contratados en lesión dos dereitos dos consumidores, nos prestamos hipotecarios en cumprimento de sentenzas ou laudos arbitrais.
